SESSION SPOTLIGHT
The Challenges for the Financial Industry of Cross-Border Business in a Changing Regulatory World (Wednesday)
Nadine Balkanyi-Nordmann - Schweiz; General Counsel EMEA, Wealth Management; UBS
In the last 5 years, legal and reputational risks associated with the provision of financial services on a cross-border basis have significantly increased, as evidenced by high-profile cases both in Switzerland and abroad. Whilst the causes of legal and reputational risks in cross-border financial services are varied, a recurring factor in the overall debate is the increasing demand placed on financial institutions to ensure the fulfillment of legal, regulatory and tax obligations by their individual clients and business partners. Tax legislation is a further source of risk. The danger here is that individual clients may not be fulfilling their home country tax obligations or that financial intermediaries or their employees may become a party to tax offences committed by foreign clients under foreign law. Further legal and reputational risks for institutions with cross-border operations may arise under foreign anti-money laundering legislation and conflict of law rules and procedural rules.
